The Jump Off — Terms of Service & Privacy Policy
Draft for beta. Plain English on purpose. Have a lawyer review before public launch.

Terms of Service
1. What this is
The Jump Off ("the Service") is a set of creative tools for making, generating, and updating digital art collections. We provide software. We are not a marketplace, not a mint, not an exchange, and not a custodian of anything you own.
2. Your account
You need an account to use the Service. Keep your password secure — you're responsible for what happens under your account. During beta, access is by invitation. We may suspend or close accounts that abuse the Service, break these terms, or put other users at risk.
3. Your work stays yours
You own everything you create or upload. We claim no ownership of your art, audio, collections, or metadata. We don't sell it, license it, train models on it, or show it to other users. We store it only to run the Service for you.
You grant us the narrow permission to store, process, and display your files back to you (and to anyone you deliberately share with, such as through Live Share) — that's it. Delete a project and we delete its files.
4. What you promise us
You will only upload work you have the right to use. Specifically:
- Art: you made it, commissioned it, licensed it, or it's yours to use.
- Audio: sample clearance is entirely your responsibility. If you upload music containing samples, loops, or any third-party recording, you are solely responsible for having cleared those rights. The Service is a tool, not a rights registry, and we do not review or clear anything you upload.
- You will not upload anything illegal, infringing, or designed to harm others.
If someone raises a credible rights complaint about your content, we may remove it and tell you why.
5. What we don't do
We don't mint anything for you. We don't touch your wallet, your keys, or your funds. Every on-chain action — minting, updating, transferring — is done by you, with your own wallet; when the Service prepares a transaction for you (see section 9), you see it and sign it yourself, and we never hold a key. Nothing you make here goes public unless you choose to publish it.
6. Beta reality
This is beta software. It may break, lose data, change, or go offline. Keep your own copies of anything you care about — export your work regularly. We take backups, but you should not treat the Service as your only copy.
7. No guarantees, limited liability
The Service is provided "as is," without warranties. We are not liable for lost data, lost profits, failed mints, missed drops, or anything that goes wrong on a blockchain. Nothing here is legal, financial, or investment advice. If a court disagrees with any of this, our total liability is capped at what you've paid us (during beta, that's nothing).
8. Changes and ending
We may update these terms; material changes get notice. You can stop using the Service and delete your projects at any time. We may discontinue the Service, with reasonable notice and time to export your work. If you have collections on Jump Off hosting, section 10 applies.
9. Hosting your art (optional)
If you choose "The Jump Off hosts it", the Service stores your published collection files (images, audio, and metadata) and serves them from our address (art.thejumpoff.xyz). This is what lets a dynamic collection change with one click instead of a new upload and a wallet transaction every time. Here is exactly what that means:
- What we host: only what you press Publish on. Nothing is hosted until you do, and only the files in the sets you publish.
- It stays yours. Section 3 applies in full. Hosting is storage and delivery, not a licence to your work. We display it because you told us to and to whoever asks for those addresses (wallets, marketplaces, collectors), which is the point.
- Every file is mirrored to IPFS. Each publish is also pinned to the public IPFS network, so a copy exists outside our servers. You can see the IPFS address of every published set in the studio.
- Every file is fingerprinted. For each collection we publish a
manifest.jsonlisting a SHA-256 hash of every live file, and each metadata file carries the hash of its image. Anyone can check that what we serve is what you published, unchanged. - You can leave at any time. "Export to IPFS" pins your collection in the standard layout and hands you the addresses. Pointing your NFTs at them is done from your own wallet, the same way you pointed them at us. There is no lock-in and nothing to ask us for.
- Pointing NFTs at hosting is your action. The Service can prepare an
NFTokenModify(or the equivalent on your chain) and hand it to your wallet app to sign. You review each one. We cannot change where your NFTs point without your signature, and we never will be able to. - Content rules apply. Section 4 covers hosted files. If we receive a credible rights complaint or the content is illegal, we may take those files down and will tell you why. Send notices to abuse@thejumpoff.xyz.
- Availability. We aim to keep hosting up and monitor it, but it is beta infrastructure and section 7 applies. The IPFS mirror and your own exports are your protection, and we recommend keeping both.
- Cost. Hosting is included during beta. If that changes, you will get notice before anything is charged, and section 10 protects your files regardless.
10. If hosting ever ends (sunset promise)
If we stop offering hosting, or stop the Service entirely, we commit to the following for every hosted collection:
- At least 90 days' notice by email and in the studio before any hosted address stops serving.
- Your files, ready to go. During that period, Export to IPFS stays available and we keep the existing IPFS mirrors pinned, so every collection has a permanent address to move to.
- The repoint path stays open. The studio's on-chain update tool keeps working through the notice period so you can point your NFTs at the new addresses from your own wallet.
- No ransom. We will never condition the return of your files or the repoint tool on a payment or a new agreement.
This section survives any other change to these terms.
Privacy Policy
What we collect
- Your email address — used solely as your account login. During beta we send no email at all; support happens over X.
- Your password — stored only as a secure one-way hash. We can never see it.
- Your files — the art, audio, and settings you upload or create.
- Basic technical logs — IP address, browser type, timestamps, error records. Used to keep the Service running and secure.
- Feedback you send us — including what page you were on.
What we don't collect
No tracking pixels. No advertising networks. No analytics companies. No selling data to anyone, ever. We don't have a data-broker business and never will.
Who can see your work
Only you — and anyone you deliberately invite via Live Share while a session is running. We access your files only when you ask for support, or when strictly needed to fix a technical problem.
Where it lives
Your projects and account live on our server (currently DigitalOcean, US). We take regular backups, retained for a limited period, and protect access to them.
If you use hosting (Terms, section 9), the files you publish are stored in DigitalOcean object storage (US) and served through a content delivery network, and a copy is pinned to the public IPFS network through Pinata. Published files are public by design — that is what hosting is for — so publish only what you intend the world to see. Unpublished projects stay private as described above.
Your rights
Ask us for a copy of your data, corrections, or deletion at any time. Delete a project in-app and its files are removed. Ask us to delete your account and we'll remove your account and files.
Cookies
One essential cookie to keep you signed in. That's it — no advertising or tracking cookies.
Children
The Service is not intended for anyone under 13 (or the minimum age in your country).
